It sounds like a sick joke, but it looks like this crime actually occurred: a substitute teacher, all of 21 years old, walks in to a cl***room and finds two boys having sexual contact with one girl, aged 14.  He asks them if they are trying to have sex with her, and then tells him he will show them how it's done.  And bends her over...
Seven students witnessed it; everyone kept their mouth shut for a while, until a week later when one of the students told his mother.
What a sad, sick story. Not only was this teenager abused, her peers watched and didn't help.  That has to multiply the trauma tremendously.

      Police began investigating David Lawson Franklin, 21, on Wednesday after a woman told the school's principal what her son said he had witnessed last week. Franklin was arrested at his home in Fort Worth and taken to the Mansfield Jail. Bail was set at $75,000.
      "Quite honestly, initially the details were such we were a little skeptical until we talked to all the parties involved," said Fort Worth police Sgt. Dave Stamp, supervisor of the Crimes Against Children Unit.
"Then skepticism turned into shock."       When officers first questioned the girl, she denied that an ***ault took place but later said it had occurred, Stamp said.
      "She was initially embarr***ed to talk to anybody about it," he said.
      Stamp said statements by other students in the cl***room match the girl's account.
      "They're all very consistent, the terminology as well as the details of the offense," he said.
      Franklin was ***igned on Jan. 23 to be a substitute at the alternative school for students with discipline problems. Stamp said Franklin walked into the cl***room and found two boys playing with the girl in a sexual manner in a space between a bookshelf and a wall.
      According to the students, Stamp said, Franklin asked the boys whether they were trying to have sex with the girl, then told them that he would show them how it's done.
      The students who were in the cl***room told police that Franklin told the girl to bend over, pulled down her pants and his own, and raped her.
      "Because she is a student and he is a teacher in a position of authority, she may have been intimidated by the fact," Stamp said.
      About seven students witnessed the incident but did nothing to stop it or report it, Stamp said. The substitute teacher told students in the cl***room not to tell anyone about it, Stamp said.
      "It's just hard to believe there were so many people present, and nobody took action to stop the ***ault or notify school staff, and we had to learn about it through a third person," he said.
      Fort Worth school district officials declined to comment on the specifics, saying they are cooperating with police on an open investigation.
      Cecilia Speers, the district's director of student affairs, said the substitute teacher "no longer is employed with the district."       Police said they believe that Franklin began teaching in the district in August, but school personnel officials could not immediately confirm how long he had been employed.

WTF did they expect the other students to do??  Two of 'em were already trying to do something to the girl........she was already between a bookshelf and the wall was it??  How handy.......already trapped and cornered............and this teacher, and how the hell is a 21 yr. old a substitue teacher in the first place, this teacher looked like quite a big guy, certainly not a match for a couple of 14 yr. olds.  Don't 'cha just love what this country is coming to?

Tiny, It??™s POSSIBLE that somebody 21 years old could qualify to become a teacher (substitute or regular) using the regular certification route. However, many school districts in this country are desperate for teachers, and there are a number of paths one could take that (emergency or alternative certification) that can speed up the time to become eligible to enter the cl***room as an instructor.

First of all it is possible that a 21 year old could legitimately become a sub...at least im my state, Michigan.  All that was required in terms of training the last time I was subbing was 60 credit hours...and I think it has been relaxed since then.  Of course you also have to have a police check to try to eliminate persons like the one in this article, but if he had no previous record...  However, I would imagine that his teaching career is over!
The thing that most intrigued me about this post, though, is that it took place at an alternative high school.  I am a teacher at an alternative high school and I kind of understand the mentality that went into the kids not telling. (Not support it of course...but I know how it works.)  My students will never, ever tell on one another no matter how terrible the situation is...being a "narc"  is the worst possible crime in their eyes. If they saw that teacher as "one of them" they would not narc on him either.We have never had a sexual ***ault in our school but have had thefts of our equipment and drug situations and I think I only once got info from a student...who came to me fearfully and pleaded for me not to let on that she had told.
Do I think that some of my male students...given the opportunity...
might ***ault a female student on school premises? Yep, probably they would...but we are very careful never give them the opportunity...students are not unsupervised.  I would question why the students were able to get the girl in that position in the first place.
Also, we are very careful with subs.  We never go through a list and hire a sub who has never been in the building.  We either use our teachers or persons familiar with the kids.  Fortunately, the local college does a "placement" program in our school...to expose their students to at-risk kids.  We encourage the students who seem to work the best with our cl***es to get certified to sub and we hire them.

The school in question is Horizons Alternative School, a middle school for children with discipline problems. They probably have to beg people to teach or substitute there.

Hi, Jan, (Welcome back!) Yep, in the Fort Worth ISD.  (I wanna go on record as saying that FWISD is rougher than the districts in the suburbs...but that may be a given.  Eons ago ['73], I interviewed at a Jr. High in FWISD, and the first thing the Principal did was open a drawer and show me a box-cutter and something else [I've forgotten what the second thing was] that two girls had tried to use on each other in a fight the week before.  And that was a "regular" Jr. High in an upper middle-cl*** area...well, it was Wedgwood, where that man killed and wounded so many in the Baptist Church over there.
This man accused of rape has a lot of supporters, from family members to his preacher.  IIRC, they pooled their money to bail him out.  His mother works at that same school, and her only explanation was that perhaps the kids were trying to get back at *her* for something by making up this story.  The substitute teacher has a wife and child.  I haven't a clue whether he's guilty or innocent.

Granted, the teacher looks are bad. But even if his DNA was found on the girl,  wouldn't it only prove he had sex with her? Who says he wasn't invited? The girl was already busy with two other guys... in a cl***room of all places. At this point, what's one more? I don't think her case is very strong.

Because the rapist was 21 years old, and everyone who kept quiet was in middle school (11-14? I suppose).  Not exactly baby boomers.

I guess you missed the first sentence of the news article.  With the words "14-year-old girl".
Which translates to "unable to grant consent under the law".
Oh, and if you get her to sign a contract, that won't hold up legally, either.  Because, you know, she's 14.

And match his DNA to what?  The story didn't come out until a WEEK after the attack.  You think she still has a semen sample in her? After a week?
Somehow, I don't think so.  Unless she has something like Monica's famous stained dress, I'd say there is no forensic DNA to use for a comparison to a suspect.

She was 14.  I don't care if she was writing on the floor naked and begging for it, she's fourteen, it's statutory rape, and the operative word in there is "rape".
And while I don't know the exact qualifications for being a substitute teacher in any given locality, I would think somewhere along the way somebody might have mentioned, even in an offhand, casual way, "by the way, don't have sex with underage teens, that's, you know, a felony."  You know, maybe not specifically 14 year olds, but in general, that you needed to look for a girlfriend elsewhere, 'kay?
I suppose "her case" is the lawsuit her parents will file against the school district.  That case is very strong, she'll collect a bundle.  Well, actually, her parents and the lawyers will collect, whether she herself ever sees a dime of that cash is another question.
More importantly is the People's case, as in "the people versus...." which is the way they word criminal indictments.  This guy committed statutory rape, there were witnesses, and in an egregious case like a school teacher, judges are inclined to hand down jail or prison time.
