School district administrators viewed the incident as sexual har***ment, suspended him for three days and are considering placing him in an alternative school.
"This is crazy," said Sal's mother, Silvia Santana. "It's a shame that a guy trying to be cute with a girl can get himself into this much trouble. I don't think he even knows what sexual har***ment is." El Paso school district spokesman Luis Villalobos said no one with the district can comment on the case, but he said the events leading to Sal's punishment were witnessed by a teacher at the Northeast El Paso middle school.
"This is a real sensitive issue, but nonetheless one that is covered in the student handbook, which we enforce," Villalobos said. "He's facing the discipline measure that's appropriate for the offense." The school district has received four other reports of sexual har***ment at the middle- and high- school levels this year, two of which were substantiated, Villalobos said.
Last year, four incidents -- two from middle schools -- were reported.
Villalobos could not say what disciplinary actions the district took in any of the cases.
Silvia Santana and her husband, Salvador, have a meeting today with the district's director of student services, Gloria Boyer, who has the authority to set aside the planned disciplinary measures in Sal's case.
Salvador Santana said they will appeal to the school board if necessary and will probably sue the district regardless of what happens.
"It's got to be done because God knows how many other kids have been involved in something like this," Salvador Santana said, adding that his son has had no disciplinary problems in school this year.
He said the family received a detailed account of what allegedly occurred during a meeting last week with Magoffin Principal Rose Rios and a district representative.
"The teacher said he stuck his tongue out and moved it back and forth and waved at her like you were patting someone on the back and that that constitutes sexual har***ment," Salvador Santana said. "She said the girl was upset and scared." The district's student code of conduct states that "sexual har***ment of a student by another student includes unwanted and unwelcome verbal or physical conduct of a sexual nature, whether by word, gesture or any other sexual conduct, including requests for sexual favors." Sal said he doesn't remember receiving any instruction about sexual har***ment in cl***. But Villalobos said Rios reported that there have been at least two training sessions for students this year.
Psychologist Karen Gold said it is not only important that students receive sexual har***ment training in the sixth or seventh grade, but that they understand it, as well.
"There's a question mark: Was the lesson properly taught and learned?" Gold asked. "There's also a question here of the punishment fitting the crime." She suggested that Sal should have been given an opportunity to apologize to the girl if his behavior was inappropriate.
"Not being able to make amends does not give the child the chance to learn the appropriate behavior," Gold said. "The school should be a training ground, not an arena for punishment. Teachers are there to teach, and kids are there to learn." Sandra Lloyd, chairwoman of educational psychology at UTEP, said schools need to be sensitive to young students and careful in judging their actions.
"That's particularly true at that age when boys and girls are just beginning to get interested in each other," Lloyd said.
But, she said, "I have heard of some terrible examples of har***ment at this age level, though this doesn't seem to sound like one.
"Sometimes the punishment may seem extreme, but on the other hand, if we don't have some kind of policy in place for this, then that is also a problem." Some parents of seventh-graders at Magoffin Middle School were surprised to hear last week that a student was being disciplined for alleged sexual har***ment.
"That's something new to me. I never heard of it," Eduardo Marquez said. "It's ridiculous to do that to a little boy. If he touched her or looked up her dress, that would be different." Marquez said he knows from his son that there is a lot of pressure to have a girlfriend or boyfriend at the school.
"It's stupid," Mercedes Nolan said of Sal's punishment while waiting for her seventh-grade daughter. "But at 12, kids have no business going out on dates or anything. They should be studying." Sexual har***ment cases at high schools and middle schools in the area's three largest school districts: El Paso: Five cases reported this year and four last year. No information was available about the disposition of the cases.

I'd still really like to know why men are the only remaining birth group against whom casual social cruelty is condoned and promoted. Men are expected to willingly be the butt of jokes told in public and on television, with some underlying understanding that we "deserve it" for our "horrific" historic behavior. We're the only group expected to be "big enough" to take such damage, and to take it silently or agree with the slurs against us, regardless of individual responsibility.
This is not equality. It's terrible hypocrisy to condemn behaviors relating to one group and condone them relating to another while pretending that the groups are fundamentally *the same*.

Sorry, but I'm not going to follow anyone's party line musings here. Were you there when this happened? What if this kid was on the "rough" side to begin with, like a bully?
From the description in the article, it sounded like the boy was waggling his tongue in the manner of suggesting cunnilingus. This is a gesture I've seen *many* times in certain "urban" locales -- I don't think they were talking about the "neener neener" thing that little kids often do.
This could have been something a 12-year-old could have learned from "ghetto" and "hip-hop" culture that is quite popular these days...

Overtly intimidating behavior like this can distract and interfere with the school's intended purpose of educating the student. What if you had an "innocent" 12-year-old daughter and somebody was making unwanted sexual suggestions at her?
When such unwanted gestures were directed at me in the past, they had the effect of catching off-guard and pissing me off -- pissing me off to the point where I felt like going up to the jerks and clipping them under the jaw; or keeping a small spray-bottle filled with that bitter-tasting liquid used to train puppies not to chew, etc. (which I could have gotten away with since this often occurred while I was riding a bicycle) -- although I never did, because it was rare that I ever saw the same person more than once. (Now before anyone decides to comment on this, just consider how you might feel if you commonly encountered strangers who loudly exclaimed how much they wanted to steal your car or **** your girlfriend, for instance -- sooner or later you'd probably feel like teaching them a lesson in manners, too...) In a schoolyard, of course, the rules are different; and you can't just walk away from it and hope you'll never see the same people again.
So you see, such behavior could be cl***ed on the same level as a kid trying to pick a fight, or threatening that they're going to steal from another kid, etc.
At the very least, he should have gotten yelled at by the principal; I'm not so sure about the suspension part although I don't know how they deal with kids nowadays who do other things as described above. (Also, I don't know why they continue to think "suspension" is effective since many kids enjoy their freedom from having to go to school. A better idea would be to make punished students have to attend extra evening cl***es!)

By 'hostile environment', feminists seem to mean 'any environment in which a woman might at some time experience stress'. Making boys walk on eggshells to try to avoid being guilty of creating a 'hostile environment' and recieving merciless 'justice' should they ever fail, even inadvertantly, is not a good policy for America to continue following. If you can't see that, you might be a feminist.

Last night NYPD Blue was on. They cops on that show, said to be very realistic, commonly arrest any man standing near a crime and beat him until he confesses. NYPD shoots unarmed men, uses toilet plungers on minor criminals, beats men for looking wrong, and generally has a lot of similarity with the Ba'ath party cops. Yesterday the media went on a tour of the Ba'ath party cops prison in Basra. I was left wondering how that is intrinsically different from Rikers Island? I wonder if the Ba'ath Party cops use toilet plungers to kill their victims like the NYPD.
We do know that the Ba'ath party cops also take children from their fathers homes. Very similar to US cops in many respects.
The US now has more men in prison than any country at any time in the history of the world. It's a shame we can't get the US Marines to liberate us.
