"It is my duty as a commissioned officer of the United States Army to speak out against grave injustices." said 1st Lt. Ehren Watada, a member of the Stryker unit, 3rd Brigade, 2nd Infantry Division. "My moral and legal obligation is to the Constitution and not those who would issue unlawful orders. It is my conclusion as an officer of the armed forces that the war in Iraq is not only morally wrong, but a horrible breach of American law." Watada is a 28-year-old Hawaii native who said he twice tried to resign his Army commission as an officer because of his opposition to the Iraq War.
He has not previously served in Iraq but is scheduled to deploy to the city of Mosul with his unit.
Watada joined the Army in 2003 and said he supported the war at the outset because he believed Iraq had weapons of m*** destruction. Since then, he said he has become convinced the Bush administration "intentionally manipulated intelligence" in order to go to war.
In an interview with The Seattle Times he said: "I feel that we have been lied to and betrayed by this administration. It is the duty, the obligation of every soldier, and specifically the officers, to evaluate the legality, the truth behind every order - including the order to go to war." Highest Ranking Protest to Date Watada is the most senior officer to go public and challenge his orders to go to Iraq.
Others have filed for conscientious objector status, which is an objection to all war. Watada, however, said he is not filing as a conscientious objector because he does not oppose all war - just this one.
"The wholesale slaughter and mistreatment of the Iraqi people with only limited accountability is not only a terrible moral injustice but a contradiction to the Army's own law of land warfare," Watada said.

Article 87 of the UCMJ: "Any person subject to this chapter who through neglect or design misses the movement of a ship, aircraft, or unit with which he is required in the course of duty to move shall be punished as a court-martial may direct." Elements.
(1) That the accused was required in the course of duty to move with a ship, aircraft or unit; (2) That the accused knew of the prospective movement of the ship, aircraft or unit; (3) That the accused missed the movement of the ship, aircraft or unit; and (4) That the accused missed the movement through design or neglect.
Court marial his ***. Sentence him to hard labor making little rocks out of big ones.

Yeah, but he's only a lieutenant. He doesn't get to decide how to 'interpret' the Constitution to meet his own, pussfied ways. He's one step up from pond scum in the chain of command (whereas a 2nd Lieutenant IS pond scum). He is not expected to think for himself.
There are many more experienced, higher ranking officers to do the thinking for him. HIS job is to willfully obey those orders.
When you join the military, there is always a chance you will be sent to war. You don't get to pick and choose which war you 'want' to fight.
He is absent with design to miss a troop movement. A court martial is warranted. With possible punishment of "Dishonorable discharge, forfeiture of all pay and allowances, and confinement for 2 years." Or, most simple answer: He's a pussy. Not wanting to fight on 'moral' grounds is just an exscuse not to get his precious *** shot off.
(Gee, maybe I shoulda thought it was 'against the Constitution' for them to station me way up North. If I had had moral problems with freezing my *** off maybe they would have stationed me in Hawaii. ) He signed the paper.
He took the oath.
He took his paycheck.
Time to pay the piper.
If not, prosecute him to the full extent of the United Code of Military Justice. NOT by a civilian court.

That is exactly the line that he is ***erting in his defense for missing movement.
That the true enemy to the U.S. Constitution is in the White House.
Leading our country into an unjust invasion of an independent country that was little or no threat to the U.S. and had nothing to do with 9/11 with criminally manipulated intellegence and outright lies.

There's no justification for it, and there's no policy to carry it out, but it happens just the same. This man is extremely naive if he doesn't realize that. You don't get to choose which wars you fight. He should have been a conscientious objector, instead he's a hypocrite.

Using your logic, only the commader-in-chief would be making all decisions, everyone else just executing orders. But then the CIC gets to carry all the blame when things go wrong. (and they do/did) So the tortures, civilian casualties, collateral damage, all Bush's fault?

Okay, what is the unlawful order that he is refusing to obey? I highly doubt ANY court martial is going to say, "Hmmm. you know..those deployment orders WERE unlawful...case dismissed." He doesn't have a case. He's just raising a stink on 'moral' grounds to protect his own cowardly self.
